Coin Spendy - Terms and Conditions

1. Acceptance of Terms

By accessing or using the Coin Spendy application (the "App"), website (the "Site"), and any related services (collectively, the "Service") provided by the developer of Coin Spendy ("I," "me," "my"), you agree to be bound by these Terms and Conditions ("Terms") and my Privacy Policy (available here), which is incorporated herein by reference. If you do not agree to all of these Terms, do not access or use the Service.

2. Description of Service

Coin Spendy provides a personal finance management tool designed to help users track their income, expenses, create budgets, and gain insights into their financial habits. The Service allows users to manually input financial data and, optionally, connect to third-party financial institutions to automatically import transaction data (subject to Section 9).

3. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are using the Service on behalf of an organization (which is generally not the intended use case), you represent and warrant that you have the authority to bind that organization to these Terms. The Service is not intended for individuals under the age of 16.

4. User Accounts

Registration: To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Security: You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized them. You agree to notify me immediately of any unauthorized use of your account. I am not liable for any loss or damage arising from your failure to protect your account credentials.
Account Use: Your account is for your personal, non-commercial use only.

Use any robot, spider, scraper, or other automated means to access the Service for any purpose without my express written permission.
Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.

6. License to Use the Service

Subject to your compliance with these Terms, I grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal, non-commercial financial management purposes.

7. Intellectual Property Rights

You retain full ownership of the personal financial data and any other content you submit or input into the Service ("User Content"). However, by providing User Content, you grant me a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, adapt, and display such User Content solely for the purposes of operating, providing, improving, and developing the Service for you, and as otherwise permitted by my Privacy Policy. I will not publish your individual User Content except in aggregated or anonymized forms for analytical purposes, if applicable, as detailed in the Privacy Policy.

8. Financial Data and Disclaimers

The Service is intended only to assist you in your financial organization and decision-making and is broad in scope. Your personal financial situation is unique, and any information presented through the Service may not be appropriate for your situation. Accordingly, before making any final decisions or implementing any financial strategy, you should consider obtaining additional information and advice from qualified financial professionals who are fully aware of your individual circumstances.
Data Accuracy:
I am not responsible for the accuracy, completeness, or timeliness of the financial data you provide or that is imported from third-party institutions. You are solely responsible for verifying the accuracy of all information inputted or imported into the Service. Decisions based on information contained within Coin Spendy are your sole responsibility.
Third-Party Data:
If you use features that connect to third-party financial institutions, the data provided is subject to the accuracy and availability of those third-party services. I do not guarantee the accuracy or availability of data obtained from third parties.
No Guarantees:
I do not guarantee any specific financial outcomes or results (such as savings or investment returns) from using the Service.

I have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that I shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. 12. Termination

By You:

Effect of Termination:
Upon termination, your right to use the Service will immediately cease. If you terminate your account, or if I terminate it, I will handle your User Content in accordance with the Privacy Policy's data retention and deletion practices, subject to legal requirements. Sections concerning Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Miscellaneous shall survive any termination.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I (THE DEVELOPER OF COIN SPENDY) EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

I DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; NOR DO I MAKE ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT OR INFORMATION AVAILABLE THROUGH THE SERVICE (INCLUDING DATA IMPORTED FROM THIRD PARTIES), OR THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICE. YOU USE THE SERVICE AT YOUR OWN RISK.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL I (THE DEVELOPER OF COIN SPENDY) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (V) ANY OTHER MATTER RELATING TO THE SERVICE.

IN NO EVENT SHALL MY TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID ME IN THE LAST SIX (6) MONTHS FOR THE SERVICE, OR, IF YOU HAVE NOT PAID ANYTHING, ONE HUNDRED U.S. DOLLARS ($100 USD) OR THE EQUIVALENT IN LOCAL CURRENCY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to defend, indemnify, and hold harmless me (the developer of Coin Spendy) from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.

16. Changes to Terms

I reserve the right, at my sole discretion, to modify or replace these Terms at any time. If a revision is material, I will provide reasonable notice prior to any new terms taking effect, likely via email or an in-app notification. What constitutes a material change will be determined at my sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

17. Miscellaneous

Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Entire Agreement: These Terms and the Coin Spendy Privacy Policy constitute the entire agreement between you and me regarding the Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
No Waiver: My failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without my prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void. I may freely assign or transfer these Terms without restriction (e.g., if the project ownership changes).
Notices: Any notices or other communications provided by me under these Terms will be given: (i) via email to the address associated with your account; or (ii) by posting within the Service.
